PROBATE

Probate is a special court proceeding incident to the settling of a decedent's estate. If a person dies with or without a Will, his or her estate will be subject to probate if it meets certain minimum criteria. Mr. Parry will help guide the client through the complex probate issues of transferring property, handling Will contests and other disputes including the possibility of "undue influence," and any ambiguity that may be contained in the document.

ESTATE PLANNING

Estate Planning is simply the advanced planning for the distribution of your estate without subjecting your heirs to the long delays and sometimes penalizing costs involved in settling your estate. In many cases effective estate planning can also help avoid probate. The most common form of estate planning is the LIVING TRUST, a document that allows the successor trustee to carry out the desires of the original trustee without court involvement, in the majority of situations. A LIVING TRUST is administered by the successor trustee in accordance with it's terms in a private and, depending on the size and complexity of the estate, far more expedient manner

CONSERVATORSHIP

A Conservator is a person appointed by the court to manage the affairs of a person who is unable to manage his or her own affairs. It is a complex and detailed procedure granting many responsibilities to the conservator on behalf of the conservatee, with a great deal of accounting and other reprting requirements. GUARDIANSHIP

Guardianship is defined as a person appointed by the court to take care of a person and possibly manage their property who for reasons, usually because of age, is unable to manage their own affairs. Most commonly a guardian is a person who is legally responsible for the care and management of a child during it's minority.

POWER OF ATTORNEY

If, for whatever reason, you are unable to make sound business and personal decisions, a Power of Attorney, prepared at such time as you competent to do so, confers on another person the authority to perform certain acts on your behalf.

ADVANCE DIRECTIVE FOR HEALTH CARE

An Advance Directive is a legal document, completed and signed while you are able to do so, that advises hospital and medical personnel of your desires regarding the care you wish to receive if the time comes when you are no longer able to personally express your wishes.
